Terms of Use

These terms govern your use of this website, operated by NC Violinist LLC. Please read them carefully. If you book a performance, your booking is governed by a separate signed performance agreement, which controls over these website terms.

Acceptance of these terms

By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the site. We may update these terms from time to time; your continued use after changes are posted means you accept the updated terms.

What this site is

This website is an informational site for NC Violinist LLC. It lets you learn about our services, browse our work, submit an inquiry or booking request, and — if you become a client — access your booking through a secure client portal. The site does not itself create a booking; a booking is created only through the separate performance agreement described below.

Client portal and secure links

If you become a client, we may give you access to your booking through a private, tokenized link. These links are personal to you and your event. Please keep them confidential and do not share or forward them — anyone with your link may be able to view your booking details. Links are time-limited and expire; if a link stops working, contact us and we will send a fresh one. You are responsible for activity that occurs through a link we issued to you, to the extent it is within your control.

Acceptable use

When using this site, you agree not to:

  • Submit false, misleading, or fraudulent information, or impersonate anyone.
  • Attempt to gain unauthorized access to any part of the site, another person's booking, or our systems.
  • Interfere with, disrupt, probe, or overload the site or its underlying infrastructure.
  • Use the site to transmit malware, spam, or unlawful, harassing, or infringing content.
  • Scrape, harvest, or reuse content from the site except as expressly permitted below.

Intellectual property

The content on this site — including the text, design, photographs, video, and audio recordings — is owned by or licensed to NC Violinist LLC and is protected by copyright and other laws. Performance recordings and images of our work are our professional portfolio. You may view and share links to the site for your personal, non-commercial use, but you may not copy, download, reproduce, republish, or use our content for any other purpose without our prior written permission.

Third-party links and services

The site may link to, or rely on, third-party services — for example, our payment processor, email delivery, and messaging providers. We do not control those third parties and are not responsible for their content, policies, or practices. Your use of a third-party service is governed by that provider's own terms and privacy policy.

Disclaimers

The website and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, or that any information on it is complete or current. Nothing on this site is a quote, an offer, or a guarantee of availability; pricing and availability are confirmed only in a written agreement.

Limitation of liability

To the fullest extent permitted by North Carolina law, in no event will NC Violinist LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or relating to your use of — or inability to use — this website, even if we have been advised of the possibility of such damages. Nothing in these terms limits liability that cannot be limited under applicable law. This section governs your use of the website; the performance agreement governs liability arising from a booking.

Relationship to the performance agreement

These Terms of Use apply to the website only. If you book a performance, that booking — including scope, pricing, deposits and balances, cancellation and rescheduling, force majeure, and dispute resolution — is governed exclusively by the signed performance agreement between you and NC Violinist LLC. If anything in these website terms conflicts with your signed performance agreement, the performance agreement controls for matters relating to your booking.

Governing law

These Terms of Use are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. (Your signed performance agreement sets out its own governing law and dispute-resolution terms, which apply to your booking.)

Changes to these terms

We may revise these terms from time to time. When we do, we will update the effective date above. The current version posted here always governs your use of the site.

Severability

If any provision of these terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.
